Biafra: Court Turns Down Kanu’s Bail Request

Justice Jame Tsosho of a Federal High Court sitting in Abuja yesterday, refused to grant bail to the proprietor of Radio Biafra and Leader of Indigenous People of Biafra, IPOB, Nnamdi Kanu and two others.The court however, held that it will grant the accelerated trial of the suit.
The federal government had arraigned Kanu and two others – Benjamin Madubugwu and David Nwawuisi on a six count-charge bothering on treasonable felony.The defendants had pleaded not guilty to the charge.
The court had remanded them in Kuje prisons pending their bail application.Counsel to the defendant had prayed the court to admit them to bail.
Delivering judgement in their bail application, the trial judge held that the offenses alleged to have been committed by the defendants are grave and that it attracts life imprisonment if found guilty.
The court further held that in such instance, bail cannot be granted.The court however adjourned till February 9 for trial.
While arguing the bail application, counsel to Kanu, Chuks Muoma SAN cited sections 158 and 162 of the Administration of Criminal Justice Act, adding that he was liable to bail.
He urged the court to grant his client bail on the ground that his offence is not a capital one.He also prayed the court for an accelerated hearing.
Prosecution counsel, Mohammed Diri however opposed the bail application on the ground that the defendant has dual citizenship, and may not be available to stand trial.
The judge had on January 20 shortly after Kanu was arraigned along with two others, Benjamin Madubugwu and David Nwawuisi – ordered the Department of State Service to release the accused persons for remand in Kuje Prison.
